The Consumer Justice Foundation Alerts Public to Asset International Report on Pension Funds Chiding Manufacturer of Depakote for Executive Pay Metrics

The Consumer Justice Foundation, a for-profit corporation whose team of professional consumer advocates provides free online informational resources to consumers with regards to the potential dangers associated with certain prescription medications, hereby alert the public of a recent news report that was published by Asset International on April 4, 2012. This report stated that the New York Comptroller and five other public pension funds have submitted a shareholder resolution to Abbott Laboratories with regards to their system of executive pay.

Abbott Laboratories is the manufacturer of the drug Depakote, which is an anticonvulsant medication used to treat the symptoms of migraine headaches, epilepsy and the manic episodes associated with bipolar disorder. The report states that this shareholder resolution was submitted by the New York Comptroller as well as the pension funds including the New York City Employees Retirement System, Teachers Retirement System, New York City Police Pension Fund, New York City Fire Department Pension Fund, and the Board of Education Retirement System.

This resolution calls for Abbott Laboratories to change their executive pay system that allegedly insulates the companys executive bonuses from financial liabilities. These liabilities include a $ 1.5 billion charge-off disclosed in a filing with the U.S. Securities and Exchange Commission related to ongoing settlement discussions in the previously disclosed investigation by the U.S. Department of Justicerelated to Depakote. This possible Depakote settlement, according to the report, was made in hopes of avoiding a civil lawsuit that would be filed because of alleged off-label uses of Depakote. No legal citation yet exists for such a matter, as investigation filing codes are not released to the public and the Department of Justice does not comment on ongoing matters. Abbott Laboratories disclosed this issue through its SEC filing. News of this hoped-for settlement was originally released in October of 2011.

New York City Comptroller John Liu stated in the report that, Rewarding top executives with lucrative bonuses when the company pays massive fines for allegedly breaking the law, cheating Medicaid, or potentially putting patients with dementia and autism at risk is just indefensible. The decision regarding this shareholder resolution will be made at Abbott Laboratories annual general meeting to be held later in April.

This International Womens Day, I join women around the globe in solidarity for human rights, dignity and equality. This sense of mission drives me and millions of people around the world to pursue justice and inclusion. Looking back at the first year of UN Women, I applaud every individual, government and organization working for womens empowerment and gender equality. I promise the highest commitment moving forward.

The creation of UN Women has coincided with deep changes in our worldfrom rising protests against inequality to uprisings for freedom and democracy in the Arab world. These events have strengthened my conviction that a sustainable future can only be reached by women, men and young people enjoying equality together.

From the government that changes its laws, to the enterprise that provides decent work and equal pay, to the parents that teach their daughter and son that all human beings should be treated the same, equality depends on each of us.

During the past century, since the observance of the first International Womens Day, we have witnessed a transformation in womens legal rights, educational achievements, and participation in public life. In all regions, countries have expanded womens legal entitlements. Women have taken many steps forward. More women are exercising leadership in politics and business, more girls are going to school, and more women survive childbirth and can plan their families.

Yet while tremendous progress has been made, no country can claim to be entirely free from gender-based discrimination. This inequality can be seen in persistent gender wage gaps and unequal opportunities, in low representation of women in leadership in public office and the private sector, in child marriage and missing girls due to son preference, and in continuing violence against women in all its forms.

Nowhere are disparities and barriers greater than in rural areas for women and girls. Rural women and girls comprise one in four people worldwide. They work long hours with little or no pay and produce a large proportion of the food grown, especially in subsistence agriculture. They are farmers, entrepreneurs and leaders, and their contributions sustain their families, communities, nations and all of us.

Yet they face some of the worst inequities in access to social services and land and other productive assets. And this deprives them and the world of the realization of their full potential, which brings me to my main point on this International Womens Day. No enduring solution to the major changes of our dayfrom climate change to political and economic instabilitycan be solved without the full empowerment and participation of the worlds women. We simply can no longer afford to leave women out.

Womens full and equal participation in the political and economic arena is fundamental to democracy and justice, which people are demanding. Equal rights and opportunity underpin healthy economies and societies.

Providing women farmers with equal access to resources would result in 100 to 150 million fewer hungry people. Providing women with income, land rights and credit would mean fewer malnourished children. Studies show that higher levels of gender equality correlate positively with higher levels of per capita gross national product. Opening economic opportunities to women would significantly raise economic growth and reduce poverty.

The time is now.

Every human being has the right to live in peace and dignity. Every human being has the right to shape their future and the futures of their countries. That is the call for equality that I hear wherever I go. For this reason UN Women will place special focus this year on advancing womens economic empowerment and political participation and leadership. We look forward to continued strong partnership with women, men and young people and with governments, civil society and the private sector.

Today on International Womens Day, let us reaffirm our commitment to womens rights and move forward with courage and determination. Let us defend human rights, the inherent dignity and worth of the human person, and the equal rights of men and women.

On June 2, 2011, attorneys Jeff Hammerschmidt and Mark Broughton of the Fresno-based Hammerschmidt Broughton Law Corporation attended the Northern California Innocence Projects Justice For All Awards Dinner. The dinner, which raised $ 830,000 to continue the mission of the Northern California Innocence Project (NCIP) to free those who have been wrongfully convicted, honored twelve individuals who were exonerated of crimes they did not commit after spending years in prison. The dinner also honored law firms and attorneys who contributed much to the cause of proving the innocence of wrongfully convicted defendants.

Among the exonerees who were honored at the dinner was Armando Ortiz, whose case was handled in 2008 by Mark Broughton and NCIP (Armando Ortiz on Habeas Corpus, F045069, Ca. 5th Dist. App. 2008). Armando was wrongfully convicted in 2002 of the murders of Manar Jaber, a 19-year old Reedley woman, and her unborn child. After serving nearly seven years of two life term sentences, Armando was found innocent after it was discovered that numerous witnesses who were able to provide an alibi for him were never contacted by his own trial attorney nor called to testify at trial.

The featured speaker at the dinner and recipient of the Freedom Award was John Thompson, who was wrongfully convicted and sentenced to death for the fatal shooting of a man in New Orleans in 1984. On May 20, 1999, just hours before he was to be put to death, an investigator for his legal team found evidence of his innocence that had never been turned over to lawyers by the prosecution, which was led by Orleans Parish District Attorney Harry Connick (it was later found that his office concealed ten separate pieces of evidence in the case; Thompson v. Connick, 07-30443, 5th Cir. 2009). Thompson was given a new trial in 2003, and the jury took only 35 minutes to acquit him (State v. Thompson, 2002-0361, La. App. 7/17/02). He now runs an organization called Resurrection After Exoneration, which is dedicated to helping exonerated defendants adjust to life after prison.

Actress Juliette Lewis spoke at the dinner as well. She played a role in the movie Conviction, which stars Hilary Swank. It is based on the remarkable true story of Betty Anne Waters, a woman who put herself through law school in order to get her brother released from prison for a crime he did not commit.

The Northern California Innocence Project provides hope and justice to those who have been wrongfully convicted, says Jeff Hammerschmidt. The value of their work cannot be overstated and their dedication to freeing the innocent is inspiring. It was humbling to be in the presence of men and women who were finally freed after serving a combined 130 years for crimes they did not commit.

Presidents Call For Jobs and Justice Fuels Rallies By National Black Farmers Association

The call for jobs and a renewed emphasis on civil rights in the State of the Union address will echo through upcoming rallies, according to Dr. John Boyd, president of the National Black Farmers Association.

In a series of regional events, black farmers will urge Congress and President Obama to act now on a promised $ 1.15 billion to remedy decades of discrimination.

The nations treatment of black farmers is a blight. Empty promises only make matters worse, said Dr. Boyd. It is time for Congress to do the right thing and compensate discriminated black farmers for the governments wrongs against them. It certainly has found the will to fund far less worthy and much more expensive causes.

Beginning on February 6 in Little Rock, Arkansas, black farmers and supporters from some of the most depressed areas of the country will come together to insist on long promised and long delayed justice. It was back in 1999 that the government agreed to one of the largest civil rights settlements in our history, the Pigford case, due to discriminatory practices by the USDA.

In his State of the Union address, President Obama observed: “We find unity in our incredible diversity, drawing on the promise enshrined in our Constitution: the notion that we are all created equal, that no matter who you are or what you look like, if you abide by the law you should be protected by it; that if you adhere to our common values you should be treated no different than anyone else.”

On the other side of the aisle, Governor Bob McDonnell of Virginia found it easy to agree on the subject of job creation.

“We were encouraged to hear President Obama speak this evening about the need to create jobs,” said McDonnell. “All Americans should have the opportunity to find and keep meaningful work, and the dignity that comes with it.”

But for black farmers, the ideals laid out by both President Obama and Governor McDonnell have been only a dream. Black farmers and supporters will rally throughout the Southeast culminating in a rally in front of the US Department of Agriculture in Washington, DC to make heard the urging of thousands: keep your promise; justice now.

Health Justice CT to Host “TweetChat” to Discuss Health Disparities Experienced by Men of Color

On Tuesday, December 14, from 1:00pm to 2:00pm EST, Health Justice CT will host a free TweetChat to discuss what communities can do to help end health disparities among men of color. HealthJusticeCT is an innovative initiative designed to use social media channels as the foundation for raising awareness about the issue of racial and ethnic disparities and creating a vital movement of Connecticut residents dedicated to working together to develop innovative solutions and ultimately achieve health justice for everyone in Connecticut.

The TweetChat, an online discussion forum conducted on Twitter, will be moderated by Giovanni Rodriguez (@giorodriguez), social media expert and board member of Latinos for Social Media (LatISM); and public health activist and commentator, Andre Blackman (@mindofandre).

Evidence shows that racial and ethnic minorities are often disproportionately affected by health problems. Health Justice CT is taking a leadership role to address this issue by using social media to build public support and create an agenda for action.

This Health Justice CT TweetChat will be the second in a series that will address topics of health equality and health justice in the state of Connecticut.

Questions to be discussed include:


How does poverty factor into the poor health of men of color?
Do men of color experience worse health outcomes and treatment than their socioeconomic counterparts?
What new solutions should be implemented or tested to help solve this problem?
How does where people live, work and play impact their health?
